Racial Discrimination
Any person of any race can be the victim of racial discrimination in the workplace. Depending on where your workplace is located, there are federal and state laws that protect you from racial discrimination. Some of these laws specifically prevent your race from being used as a basis for:
- Hiring
- Promotion
- Discipline and discharge
- Wages and benefits
- Transfer
- Work assignment
- Performance evaluations
- Job training
- Any other term or condition of employment
Racial discrimination can be overt in harassing comments and jokes and the use of racial slurs, for example. But it can also be more subtle in the application of company policy unequally or other less obvious forms of differing treatment. The employee could be paid less than another employee based on race but wouldn’t know it immediately if the payment is discouraged from discussion at the workplace. Or a promotion could be given to the employee specifically to set them up for failure and termination by not training them properly for the new position. Sometimes the discrimination can affect an entire group of employees at once.
Whether racial discrimination is obvious or not, it can have a huge impact for a long time on anyone subjected to it. Your career and livelihood should not be determined by the color of your skin.
If you have been the victim of racial discrimination you must take immediate action as the time limits for filing a claim are very short.
